DEFERRED ACTION FOR CHILDHOOD ARRIVALS (DACA)

Deferred Action for Childhood Arrivals (DACA) allows certain youths to live and work in the U.S. for two years without being removed from the country. Although deferral does not grant legal status in the U.S., a request can be made after two years to renew the deferred action. Randall Law can help you determine if you qualify for DACA, help you apply for it, and help prevent processing delays or denial of your request.

Who Is Eligible for DACA?

You can request DACA if you meet all of the following requirements:

  • Were under age 31 as of June 15, 2012;
  • Came to the U.S. before you were 16 years old;
  • Have continuously lived in the U.S. since June 15, 2007, and currently live in the U.S.;
  • Were physically in the U.S. on June 15, 2012 and when you requested deferred action with United States Custom and Immigration Service (USCIS)
  • Did not have legal status in the U.S. on June 15, 2012;
  • Are currently in school, have graduated from high school, have obtained a certification of completion, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or U.S. Armed Forces;
  • Do not have convictions for a felony, a significant misdemeanor, or three or more misdemeanors; and
  • Are not a threat to national security or public safety.

How Do You Apply for It?

You can request a deferral by completing and submitting the following forms to USCIS:

  • I-821D, Consideration of Deferred Action for Childhood Arrivals
  • Form I-765, Application for Employment Authorization
  • Form I-765WS, Worksheet

Be certain to obtain the current version of the forms from the USCIS website.
